The prosecutor's appeal is dismissed.
Reasons
1. The gist of the grounds for appeal is that the court below acquitted the victim of the charges of this case even if it is sufficiently convicted of the charges of this case, taking into account the following: (a) the victim asserts from the investigative agency to the court below that the defendant exceeded the upper floor by shouldering the defendant's shoulder; (b) the victim appears to have pushed the victim with a view to not falling under the stairs under the stairs; and (c) the victim's injury diagnosis corresponding to the victim's statement was made; and (d) the court below acquitted the victim of this case
2. The lower court’s judgment: (a) in light of the circumstances such as ① the fact that the victim exceeded the victim was clear; (b) the victim was in the position of only the defendant at the time of the victim’s appearance; (c) the defendant was also aware that there was a dispute with the victim; and (d) the defendant consistently stated that the victim was pushed down; (b) the victim was not likely to have been pushed down; (c) the victim changed his/her statement as to whether the victim was pushed down or was sealed by hand; and (d) when the testimony was made at the court of the lower court, the victim made a statement that he/she did not memory as to this part; (b) the defendant was under water cleaning with the storm; and (c) the victim was under water cleaning at the time of the lower court’s trial; and (d) the victim stated that the victim was in conflict with his/her own investigative agency’s statement by failing to clean the water; and (e) the victim’s statement made in an investigative agency beyond the possibility of cleaning the victim’s statement.
