A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

피고인은 2017. 7. 28 05:10 경 부산 연제구 B에 있는 “C 요양병원” 주차장에서 술에 취하여 잠을 자 던 중 112 신고를 받고 출동한 D 지구대 경사 E( 이하 ‘E 경사 ’라고 한다), 경장 F( 이하 ‘F 경장’ 이라 한다 )으로부터 귀가를 권유 받자 “ 개새끼야! ”라고 욕설을 하며 벌떡 일어나, 머리로 E 경사의 얼굴 부위를 들이받고, 이를 제지하는 F 경장의 다리를 오른발로 1회 찼다.
