Examining the reasoning in light of the record, we affirm the judgment of the court of first instance that found the Defendant guilty on the charge of obstructing the performance of the official duties by deceptive means among the facts charged in the instant case, on the grounds stated in its holding. There is no error of law by exceeding the bounds of the principle of free evaluation of evidence in violation of logical and empirical rules, or by misapprehending the legal principles on the obstruction of the performance of the official duties by deceptive means, contrary to what is alleged

On the other hand, the prosecutor appealed the entire judgment of the court below, but the guilty part does not state the reasons in the petition of appeal and does not state the reasons for appeal in the notice of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
