1. The plaintiff's appeal and the selective claim added by this court and the conjunctive claim are all dismissed.
2. Appeal.
Reasons
1. Basic facts
A. The Plaintiff is a company that runs the cargo transport business, etc., and has been delegated to the Becroer (BEk Broker) and Brogists (BT Logists Ltd.) in connection with customs clearance and local transport in Uzbekistan.
B. The Defendant (formerly referred to as the “GCC”) was entrusted with the transportation of cargo (such as construction materials, tools, etc. necessary for the construction of gas plant in Uzbekistan in relation to the construction of GSS, modern engineering, and Samsung Engineering’s construction of gas plant in Uzbekistan) from owners, such as Sung Chang-NC Co., Ltd. (hereinafter “Sho Chang-si”) and Han Han-gu Co., Ltd. (hereinafter “Korea Open-si”), and delegated the Plaintiff with the 17th container container container as indicated in the attached list (hereinafter “instant container”) from Incheon or the United U.S. Emirate, including the transportation of the 7th container, the transportation of the 35th container container, and the customs clearance at the local level.
The Plaintiff re-entrusted and processed the instant container’s customs clearance and transportation work to the construction site of the UGCC project with vebromoer and non-tactic agents.
C. The content of the day the Plaintiff delegated by the Defendant with respect to the instant container is the maritime transport to (a) (b) and the local customs clearance in Uzbekistan, and (c) to the construction site of the UGCC project. The Plaintiff and the Defendant did not separately prepare the transport contract, including the amount by specific items, such as transport cost, customs clearance cost, etc., and other documents that clearly stipulate the terms and conditions of the contract.
The plaintiff and the local agency shall keep the transported goods in the bonded warehouse for the purpose of saving the time required for customs clearance and use them immediately after the completion of customs clearance.
