피고인은 2016. 1. 12. 08:53 경 자동차 운전면허를 받지 아니하고, 자동차 의무보험에 가입하지 아니한 채 위 승용차를 운전하여 거제시 사등면 가조로 46 성 포 중학교 앞 편도 3 차로의 도로를 통 영 쪽에서 고현 쪽으로 2 차로를 따라 진행하던 중 전방 주시의무를 게을리 한 채 차로를 변경한 과실로 위 투스 카니 승용차와 같은 쪽으로 1 차로를 따라 진행 중이 던 피해자 메 르 세 데스 벤츠 파이낸셜 소유 (C 운전) 의 D 벤츠 승용차 앞 범퍼 부분을 위 투스 카니 승용차의 뒤 범퍼 부분으로 들이받아 위 벤츠 승용차가 옆으로 밀리면서 중앙 분리대를 충격하게 하고, 그 파편이 반대 차로로 튕기면서 반대 차로에서 고현 쪽에서 통영 쪽으로 1 차로를 따라 진행 중인 피해자 E 소유 (F 운전) 의 G 코란도 승용차의 좌측 앞 범퍼 부분에 충격하게 하여 수리비 67,580,304원 상당이 들도록 위 벤츠 승용차를, 수리 비 614,447원 상당이 들도록 위 코란도 승용차를, 수리 비 100만 원 상당이 들도록 중앙 분리대를 각 손괴하고도 곧 정차하여 손괴한 물건 및 손괴 정도를 확인하는 등 필요한 조치를 취하지 아니하였다.
