A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) and the Defendant is a person engaging in driving a Cunst car;

On November 5, 2010, the Defendant, without obtaining a driver’s license at around 17:50 on November 5, 2010, driving the said vehicle under the influence of alcohol content of 0.197%, and driving the said vehicle under the influence of alcohol content of 0.197% on a road in front of the “Nean Motor Service Center” located in the Seo-gu, Seo-gu, Seo-gu, Seocheon-gu, Chungcheongnam-gu, Chungcheongnam-gu.

At the time, since it is night and a narrow road where a center line is installed, a person engaged in driving of a motor vehicle is prohibited from driving the motor vehicle without a driver's license as above, as well as from driving the motor vehicle by safely driving the motor vehicle by complying with the median line and thoroughly driving the motor vehicle.

Nevertheless, under the influence of alcohol as above, the Defendant: (a) caused the injury of the victim D(36 years old); (b) the part of the victim’s Eknife vehicle’s Eknife vehicle (hereinafter “victim”) driving the central line at normal intervals due to the negligence in a situation where normal driving is difficult, such as sniffing and sounding the smell on the face; and (c) caused the victim F. (35 years old) who is the passenger of the damaged vehicle to suffer from the injury, such as the knife, etc., of the knife vehicle’s knife in front of the above knife vehicle volume (hereinafter “victim’s vehicle”); and (d) caused the victim F. (35 years old), who is the passenger of the damaged vehicle, to suffer from the injury of the damaged vehicle, such as the knife of the upper part of the knife, which requires the right-hand treatment for about 10 weeks; and (d) damaged the damaged vehicle at the same time.

2. The Defendant violates the Road Traffic Act and the Road Traffic Act (driving without a license) shall be placed in the same Eup/Myeon under the influence of alcohol concentration of 0.197% without obtaining a temporary driver's license as stated in the preceding paragraph.
