Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. A person who intends to fell standing timber, extract and gather forest products in a forest violating the Creation and Management of Forest Resources Act shall obtain permission from the head of a Si/Gun/Gu or the head of a regional forest office;

Nevertheless, on July 2013, the Defendant extracted 17 pine trees using refraters, etc. without obtaining permission within C, D, E, and F forests from the end of the city.

2. A person who intends to temporarily use a forest road for violating the Management of Mountainous Districts Act, work roads, forest products transportation roads, forest paths, such as mountain trails and forest trails, or other similar mountain paths shall report thereon to the Minister of the Korea Forest Service with respect to mountainous districts of state forests, and to the head of Si/Gun/Gu with respect to mountainous districts of

Nevertheless, on July 2013, the Defendant: (a) mobilized so as to take out pine trees, which were extracted without filing a report within 1,391 square meters among G 2,638 square meters; (b) 482 square meters among G 2,638 square meters; (c) 3,199 square meters among 29 square meters; (d) 69 square meters among 3,185 square meters; (e) F 4,103 square meters among 1,39 square meters, 530 square meters among 1,39 square meters; and (e) expanded the mountain paths to 4.2 meters and used them for work; and (e) caused damage in mountainous districts equivalent to KRW 15,630,00,00 by putting them into a mercation work, thereby causing damage to mountainous districts of KRW 15,630,00.

3. A person who intends to move pine trees produced in an area other than an area prohibited from removal of pine trees in violation of the Special Act on Disease Control and Removal shall obtain approval seals for confirmation of production from the Minister of the Korea Forest Service or the head of a Si/Gun/Gu or obtain production confirmation marks

Nevertheless, the Defendant, at the end of July 2013, extracted pine trees as described in the above Paragraph (1) with H, used five tons of freight cars without obtaining approval seal for production verification or being issued a production verification mark, and moved them to the place of a household decoration and apartment construction site located in Seoul Metropolitan City.
