1. The defendant (Counterclaim plaintiff) shall all dismiss the counterclaim.

1. We examine the legitimacy of the counterclaim that the Defendant (Counterclaim Plaintiff) raised ex officio.

A counterclaim may, in case where a claim which is the object of a lawsuit is related to a claim or defense method of the principal lawsuit and the litigation procedures are not remarkably delayed, be instituted not later than the time the pleadings in the principal

(Article 269(1) of the Civil Procedure Act. In this case, the Defendants’ counterclaim is unlawful since it is apparent in the record that it was filed on September 3, 2018, which was after the closing of argument in the principal lawsuit.
