1. The Defendant (Counterclaim Plaintiff) indicated the attached sheet No. 5, 2, 7, 6, and 5 on the attached sheet No. 5, 2, 7, 6, and 5 to the Plaintiff (Counterclaim Defendant).

A principal lawsuit and a counterclaim shall be deemed simultaneously.

Basic facts do not conflict between the parties, or each of the following facts can be acknowledged in full view of Gap evidence 1-1, 2, Gap evidence 2-8, Eul evidence 1-2, Eul evidence 2-2, Eul evidence 3-2, Eul evidence 4-1, 2, 3, 4, Eul evidence 5-1, 7-2, Eul evidence 7-1, 7-2, and the whole purport of the arguments as a result of the request for appraisal by the Director of the Korea Land Information Corporation and the President of the Korea Land Information Corporation.

On October 8, 1981, the registration of ownership transfer was completed in the name of F on October 2, 1981 with respect to 40/66 of the land E (hereinafter referred to as “land before subdivision”) before the subdivision, and the annex to the land before subdivision and the annex to the land before subdivision and the building-to-land construction of 17 square-pinbbebs (hereinafter referred to as “building before subdivision”) have been completed in the name of F.

B. On August 30, 1989, G G-si 132 square meters (hereinafter “instant G land”) was divided into the land before subdivision.

On September 8, 1989, the division was finalized under the Act on Special Cases Concerning the Partition of Co-owned Land.

Since then, the registration of ownership transfer was completed on October 31, 1989 with respect to the building of the instant G land and the land before subdivision due to sale on May 20, 1989. The prior approval was granted for the use of the building before subdivision on May 9, 1987. Since then, the indication of the building was changed to the “Gement block structure and 58.76 square meters of the land before subdivision” (hereinafter “instant building”).

The Defendant entered into a sales contract for the instant G land and the instant building between H on March 19, 2017, and completed the registration of ownership transfer in the name of the Defendant on April 19, 2017.

E. Meanwhile, the Plaintiff completed the registration of transfer of ownership in the name of the Plaintiff on August 29, 2007, on the ground of sale as of August 14, 2007 with respect to the Plaintiff’s land located in the Gu-si 165 square meters adjacent to the instant G land (hereinafter “instant Plaintiff’s land”).
