The defendant shall be innocent.

1. Facts charged;

A. On June 2017, the Defendant destroyed property by cutting off approximately one meter of 485 square meters installed in the victim C’s land owned by the Defendant, which was located at approximately 485 square meters in the Defendant’s wife B, Young-si.

B. On June 2017, the Defendant: (a) removed the steel pents from the cafeterias of the victim C, which were located in the Defendant’s wife B, as stated in Section A; and (b) entered the said cafeterias to intrude the victim’s structure.

2. Determination

A. Although the Defendant was aware of the fact that he had a steel fence owned by the victim, the Defendant denied the charge as of June 27, 2017, rather than the first policeman on June 27, 2017.

In full view of the following circumstances revealed by the evidence duly adopted and investigated by this Court, the evidence submitted by the Prosecutor alone was destroyed by the Defendant’s pension in early June 2017.

The recognition is insufficient, and there is no other evidence to prove it.

① On June 1, 2017, the Defendant arbitrarily constructed a road of three meters in width by destroying steel pents 17 meters installed on the ground of the land owned by the Defendant, which is located on the land owned by the Defendant, located on the land owned by the Defendant, with the gradient lowered.

In this regard, the defendant was accused of theft and damage to property.

However, the victim's statement was merely a defendant since it was opened a road on the land owned by the victim, as seen at the scene around June 13, 2017, and around 20 meters of the building site, and there was a dispute over the ground problem, and therefore, the defendant was only the defendant, since he was the defendant, who was in the early June 2017, damaging the above pents, and it is merely an incidental side. The victim's statement is merely a witness to the prosecution. The photograph of the steel pents (Evidence No. 17 of the evidence record) destroyed by the victim submitted to the investigative agency, and the above pents had already been installed as a patrol officer on June 1, 2017.
