A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On September 13, 2007, the Defendant issued a summary order of KRW 1.5 million for a crime of violating road traffic law (drinking) at the Goyang Branch of the Jung-gu District Court on September 13, 2007 and a fine of KRW 2.5 million for the same crime at the same court on January 9, 2012.

The defendant is a person who is engaged in driving of a C-III truck.

1. On July 5, 2018, the Defendant: (a) driven the above cargo while under the influence of alcohol content of 0.228% in blood around July 15, 2018; (b) led the Defendant to drive the above cargo while under the influence of alcohol concentration of 0.228% in the blood; and (c) proceeds from the road adjacent to the 465-1 Triang-gu, Seoyang-gu, Seoyang-gu, Seoyang-gu, Seoyang-gu, Seoyang-gu, the area of the road near the

The left-hand side has a safety sign of “Prohibition of Entry” and “Prohibition of Access to the left-hand turn” on the left-hand side, so the Defendant had a duty of care not to enter the road as prohibited by the direction of safety signs.

Nevertheless, the Defendant was negligent in entering the road where safety signs for prohibition of entry are installed in a state where normal driving is difficult due to influence of drinking, and the driving E of the victim D(27) or the front part of the car was driven in the opposite direction.

As a result, the Defendant driven the above cargo in a state where normal driving is difficult due to influence of drinking, and suffered injury, such as “the catum catum, tension, etc.,” which requires approximately two weeks medical treatment to the victim.

2. Violation of the Road Traffic Act (drinking) driving the above cargo vehicle under the influence of alcohol by 0.228% from the 30km section of the blood alcohol concentration at approximately 30 km to the roads near the 465-1 Gangseo-gu, Seoyang-gu, Seoyang-gu, Seoyang-gu, Seoyang-gu, Seoul, where the location located in the Ri as referred to in item (g) of the Dongyang-gu, Seoyang-gu, Seoyang-gu.
