The judgment of the court below is reversed.

The sentence of punishment against the Defendants shall be suspended.

The main points of the grounds for appeal are as follows: (a) the Defendants conspired with A, B, and D to occupy the stairs of the community hall; and (b) the Defendants interfered with the HH tender of the fishing village fraternity (hereinafter “instant tender”) led by the president of the fishing village fraternity in collusion with the latter.

In the first instance of the trial, the prosecutor first applied for the amendment of indictment which adds the following facts charged and applicable provisions of law, and the subject of the trial was changed by this court's permission, so the judgment of the court below is no longer maintained in this respect.

[Preliminary Facts of the charge] The defendant C is a member of the H fishing village fraternity established in the G Group in the Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, and the defendant E is a member of the above Emergency Countermeasure Committee A. The above fishing village fraternity was divided into the power of the head of the fishing village fraternity centered on I and the emergency Countermeasure Committee centered on A. The defendants conspired to interfere with the bidding of the H fishing village fraternity conducted on the second floor of the G community center in the Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, and the second floor of the above community center in collusion with the defendants to interfere with the bidding of the above 3rd floor of the above community center and interfere with the bidding of the above 1st floor, and thereby helping the above bidding of the above 3rd floor in order to assist the above bidding of the 2nd floor, the above 2nd floor of the 3rd floor and the above 3rd floor in the bidding of the 3rd floor and the above 3rd floor in the bidding of the 3rd floor."
