1. 피고인 A은 2015. 12. 7. 22:40 경 청주시 상당구 D에 있는 E 편의점에서 그곳의 직원인 F에게 욕설을 하여 F과 다투던 중, 112 신고를 받고 출동한 청주 상당 경찰서 G 지구대 소속 경찰관인 H가 신고 내용 처리 및 피고인 A 의 인적 사항을 확인하기 위하여 피고인 A에게 신분증을 제시해 달라고 하자 이를 거부하며 H의 가슴팍을 밀치면서 신분증 제시 요구에 응하지 아니하였다.

계속하여 피고인 A은 H이 피고인을 폭행 혐의로 현행범 체포하기 위하여 수갑을 채우려고 하자 피해자의 손을 뿌리치며 반항하고, 같은 지구대 소속 경찰관인 I의 가슴팍을 밀치면서 저항하였다.
