A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a foreigner from Austria, who is entering the Republic of Korea through a sojourn status D-2 ( study visa) visa, and is currently attending the third grade of the International Business Department of C University.

1. At around 13:00 on April 21, 2013, the Defendant committed indecent act by compulsion by force against the victim E (V, 25 years of age) from C University Study Center located in Seo-gu, Seo-gu, Seocheon-gu, Seocheon-gu, Seocheon-gu, in the elevator, foreign victim E (V, female, 25 years of age).

2. 폭력행위등처벌에관한법률위반(우범자) 피고인은 2013. 5. 7. 17:40 ~ 18:20경부터 약 20분간 위 C대학교 F건물 1층 국제교류센터 사무실 및 복도에서, 흉기 기타 위험한 물건인 장도리를 오른손으로 쥔 채 G 등을 향해 "재학생들이 나를 따돌리고 있다, 학교에서 도와주지 않는다, 나를 보호하기 위해서는 이럴 수밖에 없다"라며 큰소리를 치며 항의하는데 사용하는 등 위 교내에서 정당한 이유 없이 범죄에 공용될 우려가 있는 흉기 기타 위험한 물건인 장도리를 휴대하였다.
