Defendant shall be punished by a fine of four million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

On July 16, 2014, the Defendant was sentenced to six months of imprisonment for fraud at the Cheongju District Court, and the judgment became final and conclusive on September 20, 2014.

1. The Defendant had already sold gallon 3 mobile phones and had no intent or ability to sell them in the number of the Defendant, but had no intent or ability to sell them. On November 28, 2013, the Defendant written a letter of intent to sell a mobile phone on the Internet Neneber website’s mid-to-galian bulletin board, and made a false statement that he/she would sell gallon 3 mobile phones to the victim B who had contacted with it, and then received KRW 1 million from the victim to the agricultural bank account (C) in the name of the Defendant on the same day.

2. On February 6, 2014, the Defendant made a false statement to the victim, stating that the Defendant did not have any intent or ability to transfer the name, even by using the cell phone opened under the name of the victim D because there was no property or any other import, and even if the victim did not intend or ability to pay the mobile phone charges paid by him, the Defendant acquired the victim’s mobile phone equivalent to the amount of KRW 814,000,000,000, which was opened from the victim’s name, and received from the victim’s mobile phone in front of the so-called Seodaemun-gu Seoul Special Metropolitan City, for three months after the opening of the mobile phone charges, and transferred the name after the lapse of three months from the opening of the mobile phone charges.

3. The Defendant did not intend to transfer the name of a smartphone even if he/she received an open cell phone, and did not have an intention or ability to pay the price due to the lack of any property or other specific income offered.
