Defendants are innocent.

The summary of the facts charged is that Defendant A was in charge of the financial affairs of the aforementioned company as the joint representative of F Co., Ltd. (hereinafter referred to as “F”), who is engaged in the dyeing work in Gangseo-gu Seoul Metropolitan Government D Building E, and Defendant B was in charge of attracting investment and the dye production. Defendant C was in charge of attracting investment as the head of the above company’s headquarters.

At the above F Office on February 16, 2015, the Defendants decided to produce the victim G with the “I” “I” to broadcast in the H broadcasting station. On April 30, 2015, when investing KRW 200 million in the production, the Defendants would pay KRW 100,000 won of principal and KRW 8 billion of final profit and KRW 170,000 of final profit on May 30, 2015, and would pay the remainder of principal and KRW 100,000 of final profit. The amount of the investment would be used as the initial production cost of the drama, and the amount would be invested at KRW 1.3 billion from the J Co., Ltd. (hereinafter “J”), and the principal and profits would be paid clearly.

However, in fact, since the above drama production was not confirmed, the investment attraction of KRW 1.3 billion was not confirmed, and the financial status of the Defendants’ operation was deteriorated and the Defendants’ operation status was proper. The Defendants thought that the Defendants would receive investment from the victim from the beginning to use the above drama for the above company’s operating funds, such as repayment of debt, payment of wages, management expenses, etc., and other program production expenses, and thus, even if receiving investment from the victim, there was no intent or ability to make the said drama and pay the principal and profits as agreed upon.

Nevertheless, the Defendants made a false statement to the victim as above, and received 200 million won from the victim to the K bank account (L) in the name of F on February 17, 2015.
