A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
From January 1, 201 to October 31, 2012, the Defendant arbitrarily embezzled KRW 18,228,820 by using disaster management funds and disaster management expenses, which are owned by victims and disaster management expenses, as follows, while working as a local administrative assistant of the Macheon City Construction and City Office Disaster Management.
1. The Defendant embezzled KRW 14,228,820 on February 1, 2012: (a) deposited KRW 1,468,314,348 of the disaster management fund, which is the victim’s possession in his/her business, in the course of withdrawing and re-deposit the KRW 1,468,314,348, which is the victim’s possession in his/her business at the Nonghyup branch office located in Macheon-si, and deposited KRW 14,831,400 of the remainder in the corporate card settlement account with the Mapocheon Disaster Management Department (NAD); and (b) deposited KRW 14,231,170 out of the said KRW 14,831,40,00 on February 2, 2012 at the said Nonghyup branch office, again deposited KRW 14,231,170 on the account of excessive disaster management in the name of the Defendant under his/her name.
On February 3, 2012, the Defendant deposited KRW 12,381,40 among the above KRW 14,231,170, in the Defendant’s personal account (FF) and embezzled by arbitrarily using it as credit card payment around that time, and deposited KRW 330,00 on February 6, 2012; KRW 15,670 on February 8, 2012; KRW 800,000 on February 10, 2012; KRW 341,750 on February 16, 2012; KRW 170,000 on February 24, 2012; KRW 50,000 on February 24, 2012; and deposited KRW 170,50,000 on May 10, 2012; and deposited the Defendant’s personal account under his/her own name as an embezzlement of KRW 182,828,280.
2. On July 31, 2012, the Defendant embezzled KRW 932,00,00 for disaster management and expenses, as well as for disaster management and expenses, which the Defendant possessed by the said Nonghyup branch office, and deposited KRW 932,00,00 from the corporate card settlement account in connection with disaster management and disaster management at the said NA branch office, and arbitrarily, around that time, the Defendant withdraws it from its credit card payment and living expenses.
