Criminal facts

1. At around 21:00 on May 26, 2014, Defendant A: (a) called “F at F’s home, a person subject to the 6-time nationwide local election in east-gun, Newannam-gun, the Republic of Korea,” and obstructed the residence voter F’s voting without justifiable grounds by taking a ballot paper out of the postal items delivered to notify the place where the postal item is located.”

2. 피고인 B 피고인은 2014. 5. 26.경 전남 신안군 E에 있는 G의 집에서 제6회 전국동시지방선거 거소투표대상자인 위 G이 거소투표용지에 기표하는 것을 도와주기 위해 방문하여 G의 처 H로부터 “우리가 뭘 알아야지. 그냥 아저씨가 찍어부쇼.”라는 말을 듣고 G의 의사를 확인하지 않고 임의로 G의 거소투표용지에 신안군의원 후보자 I에 기표한 다음 같은 날 마치 G이 기표하여 발송한 것처럼 신안군선거관리위원회에 우편발송함으로써 사위의 방법으로 투표를 하였다.
