Reasons
Punishment of the crime
The Defendant, from September 1, 2015 to March 31, 2016, was a field director of the victim C Co., Ltd. (hereinafter “victim Co., Ltd”) located in the business site of the company located in Young-gu, Young-gu (hereinafter “victim Co., Ltd.”), and has been engaged in the business of receiving and managing the site operating expenses, such as the company’s factory, from the victim company, and paying personnel expenses to the employees.
1. Occupational embezzlement;
A. On January 14, 2016, the Defendant: (a) at the E plant located in Osan-si; (b) under a product supply contract, and (c) at the F account (G) in the name of the Defendant (G) in the name of the victim company in order to conduct an automated facility electrical construction; and (c) under the product supply contract; (d) KRW 1,540,000 on the same day with labor expenses for working personnel; and (e) KRW 1,7360,00

Around that time, the remaining 7,82.22 million won, excluding 8.7 million won equivalent to the Defendant’s personnel expenses, was consumed for personal purposes, such as Internet gambling funds and living expenses.
B. On March 15, 2016, the Defendant received a total of KRW 1,8750,000 on two occasions, including KRW 300,000,000 from the victim company, and KRW 1,8755,00,00 for the victim company, and used it for personal purposes, such as Internet gambling funds, living expenses, etc. around that time.

On March 30, 2016, the Defendant, in the name of the Defendant, under the name of the Defendant, in the K plant located in the Nam-gu J of the Nam-gu, Chungcheongnam-gu, Seoul Special Metropolitan City, while performing electrical construction works for automated facilities according to the construction contract, and operating expenses, such as personnel expenses, for workers from the victim company.
