2. Whether the instant disposition is lawful
A. The plaintiffs' assertion 1) Article 17 subparagraph 1 (a) (i) of attached Table 17 of the Ordinance on Budget-gun Urban Planning (hereinafter "the Ordinance of this case") concerning the change of the form and quality of land and the gathering of earth and rocks pursuant to Article 56 subparagraph 1 (a) (iii) of attached Table 1-2 of the Enforcement Decree of the National Land Planning Act concerning the standard difference in the standard height of the ordinance of the budget-gun Urban Planning (whether it conflicts with the elevation standard under the Ordinance of the Ministry of Land, Infrastructure and Transport) provides that "the land located less than 50 meters on the basis of the standard radius (the height of the site where the main entry route in the area where the development activities are applied is connected to an agricultural and fishing village road)" among the roads that continue to continue to meet the standard height from the Dog to the west direction of the application site of this case, the above quarter of this case shall be 0 meters prior to and after the end of each quarter of this case, and it shall be 4 meters prior to and after each quarter of this case.
Even if the above 4m road in the instant quarter and Manna does not go through the Myeondo, the term “road above an agricultural and fishing village road” as referred to in the instant Municipal Ordinance refers to a road that actually performs functions above an agricultural and fishing village road, and the above road is a de facto agricultural and fishing village, such as the road condition is good compared to the neighboring rido and the traffic volume is higher than the neighboring rido, and thus, the standard end should be calculated based on the quarter point of this case.
Therefore, each of the applications in this case is contained in the Ordinance of this case.
