The Defendant’s KRW 210,000,000 and its interest to the Plaintiff are 5% per annum from May 1, 2017 to December 27, 2019.
Reasons
1. Indication of claim;
A. The Plaintiff paid KRW 419,759,630 to the Defendant as advance payment. The Defendant repaid KRW 150,000,000 among them on December 9, 2016, and agreed with the Plaintiff to repay the remainder of KRW 270,00,000 up to April 2017.
B. However, the Defendant paid to the Plaintiff KRW 60,000,000 on December 23, 2019, and KRW 10,000,000 on April 6, 2020, and KRW 30,000,000 on April 8, 2020.
C. Therefore, the Defendant is liable to pay the Plaintiff the remainder of KRW 210,000,000 (=270,000,000 - 60,000) and damages for delay.
