A defendant shall be punished by imprisonment for three years.

However, the execution of the above sentence shall be suspended for a period of five years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant knew that neighbors residing in the place of residence of the Defendant living in the former Yongama-gun C, who have a 3st degree of intellectual disability, collected and live in a mixed person without his/her guardian, and attempted to commit indecent act after having been aware of the victim’s “hinginging to our house because there is a lot of abolition on our house.”

1. From March 2016 to July 2016, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (voluntary indecent act against persons with disabilities) between around March 2016 and around July 2016: (a) from March 2016 to July 2016, the Defendant visited the victim to take out his/her residence in order to bring about the abolition in the Defendant’s residence; (b) was seated on the floor with the victim’s chest by hand during the dialogue, and the victim took part in the conversation; (c) was forced to leave the victim on his/her hand, on his/her hand, and (d) went off the victim’s upper and lower clothes and clothes on his/her floor, and (e) was frightened with the woman.
