Defendant shall be punished by a fine of three million won.
Where the defendant fails to pay the above fine, one hundred thousand won shall be one day.
Reasons
Punishment of the crime
The defendant is the user who is the representative of I in Ha in Ha in terms of harmony and is engaged in gold-type manufacturing business.
1. Violation of the Labor Standards Act;
A. The Defendant did not pay, within 14 days from the date of retirement where the cause for payment occurred without an agreement on the extension of the payment date between the parties, KRW 7,218,324 of the total amount of wages of three retired workers as shown in attached Table (1), including KRW 1,50,000 of the LaborJ’s wage on June 6, 2004, which was retired from the said workplace from the said workplace from June 3, 2013 to June 30, 2014.
B. From April 1, 2013 to September 26, 2014, the Defendant did not pay KRW 3,656,127, totaling KRW 3,60,00,00 from the date of retirement within 14 days from the date of retirement without agreement on the extension of the payment period between the parties, as shown in the attached Table 2014, the amount of wages of 414,495, the monthly wage of 840,91, the monthly wage of 371,662, the monthly wage of 9, the monthly wage of 373,283,319, the monthly wage of 745,660, and the amount of wages of 3,66,127, which were retired from Korea, as described in the above I again in the attached Table 3 (L) of the daily wage table.
2. Violation of the Guarantee of Retirement Benefits of Workers;
A. 1. A. The Defendant did not pay 16,081,743 won of retirement allowance of three retired workers as well as 3,500,000 won of retirement allowance of the LaborJ, who were retired for the period of service specified in paragraph (1) of this Article, within 14 days from the date of retirement in which the grounds for payment occurred, without any agreement between the parties on extension of the payment deadline.
B. From April 1, 2013 to September 26, 2014, the Defendant did not pay KRW 4,365,756 of K’s retirement pay within 14 days from the date of retirement without an agreement on the extension of the payment period between the parties.
