A defendant shall be punished by imprisonment for one year.

Punishment of the crime

The Defendant, “2014 Go-Ma1244, 201,” upon request from the neighbors, opened a personal phone, received the personal phone, and took profits by selling it at a heavy and portable telephone store. Furthermore, the Defendant, “2014 Go-Ma1244,” was willing to take profits by additionally opening the mobile phone without the consent of the people, using personal information known to them, and selling it at a heavy and mobile phone sales store.

1. Around January 17, 2013, the Defendant made a false statement to the mobile phone owner C, who is the Defendant’s seat in front of the Seogmun-dong, Seogsan-gu, Seogdong, Seomun-dong, Seogdong, Seoul, stating that “Around January 17, 2013, the Defendant borrowed the name of the victim C, who is the Defendant’s seat, within two weeks from the opening of the cellphone.”

However, the defendant had no intention or ability to terminate the mobile phone opened in the name of the victim C within 2 weeks, because he had lent the above victim's name and had sold the mobile phone to a heavy mobile phone sales store and intended to use the money for living expenses.

The Defendant, through three mobile phones in the above victim’s name, received three mobile phones from the above victim, and obtained property and financial benefits equivalent to KRW 2,981,00 from not paying the usage fee of the mobile phone, and acquired property and financial benefits in the amount of KRW 2,981,00 from around that time to March 19, 2013, and acquired KRW 11,831,280 from the victims listed in the above attached Table by the same method as shown in attached Table 1, as shown in attached Table 1.

2. Forgery of private documents and the display of private documents;

A. On January 17, 2013, the Defendant entered “C” in the name column, “F” in the resident registration number column, and “G building 303” in the name column, without authority, in the “E” of the mobile phone sales agent located in Seocho-gu Seoul Metropolitan Government D, and without authority for the purpose of exercising the right, in the mobile phone subscription contract form, the Defendant entered the “C”, “F” in the name column, and “G building 303” in the name column.
