1. The procedure of voluntary auction of real estate B and C (Dual) with Suwon District Court established on January 23, 2014.

1. Basic facts

A. (1) On June 30, 2010, the Plaintiff entered into a limited collateral security agreement between the owner E and F of a building D 122.2m2m2 and ground (hereinafter “instant real estate”) with respect to the instant real estate within the maximum of KRW 720,000 with respect to the maximum debt amount, and completed the registration of establishment of a collateral security agreement between E with respect to the instant real estate as to the maximum debt amount of KRW 600,000,000 with a certificate loan (hereinafter “mortgage 1”) and E, with respect to the maximum debt amount of KRW 720,000 with respect to the instant real estate.

(2) On June 9, 201, the Plaintiff entered into a limited collateral security agreement between E and E as to the instant real estate within the maximum of KRW 240,000,000 with respect to the maximum debt amount, and completed the registration of creation of a collateral security agreement with E as to the instant real estate while granting a deed loan of KRW 200,000,000 to E (hereinafter “second loan”).

B. The Defendant, on August 13, 2010, completed the registration of creation of the right to collateral security with respect to the instant real estate, which is the debtor F, with the maximum debt amount of KRW 20 million,00,000, and the debtor F.

C. The court distributes the lease deposit amount of KRW 75,00,000 to the lessee, and KRW 100,000,000,00 to the Defendant of the mortgagee, in the order of priority on January 23, 2014, when the commencement of auction procedure and distribution schedule commenced on the instant real estate by the Defendant and the Plaintiff’s application for commencement of auction, and the court distributes the lease deposit amount of KRW 100,00,000 to the lessee, and KRW 5,00,00 to the Defendant of the mortgagee, in the order of priority on January 23, 2014.
