B) B and L (hereinafter “A”) (hereinafter “B”) shall enter into an agreement, agree, without both parties’ objection, on the condition that (ju)G’s management right is transferred to “A” by means of a computer, with the following terms: (a) “A” shall ensure that the company designated by “B” shall increase the amount of KRW 1 billion by May 30, 2009, in the event (ju)G listing is maintained and the capital increase is increased; (b) “A” shall pay 1 billion won out of the unpaid credit of (ju)G, the amount of credit preferential payment, and one billion won among them to a person designated by “B” or “B” by December 31, 2009. More than “A” and “B” shall confirm that all agreements on this agreed terms have been completed; (b) prepare two copies of this agreement and affix one copy to “A”; and (c) prepare the entry “Seoul” and “B” in the column of “A” in the column of “B” and “B” in the column of “A” respectively.

Then, Defendant B had Q, an employee of (ju)G, enter “L” in the name column of “B” and “Seoul Yongsan-gu, Seoul, as “L Building 1004” in the name column of “B” of the said agreement, and had Q’s seal affixed on the name next to that of his name.

As a result, the Defendants conspired to forge a letter of agreement in the name of L, a private document on rights and obligations for the purpose of uttering.

(2) As a result of the exercise of a forged agreement, the Defendants are documents in collusion with N who knew of the fact of forgery at the time and place specified in paragraph (1) of the same Article.
