Reasons
Punishment of the crime
[2017 Gohap 426] - Defendant A
1. Although the Defendant was not a narcotics handler, the Defendant did not deal with the cryptopy cam (the crypopon; hereinafter “copon”), which is a local mental medicine, the Defendant imported, provided, traded, administered, and copon as follows.
A. On February 25, 2017, the Defendant: (a) recruited to import c/B from North Korea via China at a mutually influent restaurant located near the central market in Yeongdeungpo-gu Seoul Metropolitan City, Yeongdeungpo-gu to import c/B; (b) C intended to raise funds to purchase c/C from North Korea via China; (c) B intended to receive and deliver c/C from the supplier of c/C from China and North Korea to the Defendant; and (d) the Defendant imported c/C from China to the Republic of Korea, respectively.
B. On April 15, 2017, the Defendant left the Republic of China on April 17, 2017, and the Defendant entered the Republic of China on April 17, 2017, and entered the Republic of China, and meted from April 30, 2017 to the border area of China and North Korea, B was transferred approximately 100 g of a philopon from the supplier of the philopon to the above I apartment 601, and the Defendant delivered the said philopon to the Defendant on May 2, 2017, after putting the philopon cosmetics delivered from the above B at the airport of the Sindong-ro in the Republic of China around May 17, 2017, after entering the Defendant’s Handlopon in the Chinese air at around 3:3rd of Incheon on the date of arrival in the Republic of China on which the Defendant’s Handlopon was placed in the Chinese air.
Accordingly, the defendant imported philophones into the Republic of Korea in collusion with C and B.
B. On May 5, 2017, the Defendant provided philophones by delivering approximately 1g of the philophones imported to L from the front side of the Busan Jin-gu K apartment in Busan, Busan, to L, and providing philophones.
