Reasons
Punishment of the crime
Defendant
B operates the “H” childcare center from March 2013 to Gangdong-gu Seoul Metropolitan Government, and Defendant A served as the child care teacher of the said childcare center from October 1, 2013 to February 1, 2015.
1. Defendant A
A. On July 2014, the Defendant, in violation of the Child Uniforms Act, committed physical abuse, as described in the attached Table No. 1 and No. 2, between March 2, 2014 and January 27, 2015, on the grounds that the victimized child I (4 years of age) was lost, on the ground that the victimized child would be found to have been damaged, and twice the part of the victimized child’s neck was laid down by hand, and between March 2, 2014 and January 27, 2015, the Defendant committed a total of two times, as indicated in the attached Table No. 1 and No. 2.
B. From January 5, 2015 to January 26, 2015, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Child Education Crimes (child abuse by persons engaged in child welfare facilities, etc.) committed child abuse with respect to a child under protection by committing a total of 15 times as stated in the attached Table No. 3 through 17, on the grounds that he/she does not promptly take any liver awareness at the above child care center on the ground that he/she does not immediately take any liver awareness. In addition, the Defendant committed a child abuse with respect to a child under protection by committing a total of 15 times as described in the attached Table No. 3 to 17, 2015.
2. Defendant B’s employees, at the time and place specified in paragraph 1, committed physical abuse against the Defendant’s children in relation to the Defendant’s duties.
