1. On November 28, 2017, the Defendant posted a notice to the effect that he/she “transfers online game D E positions” on the bulletin board of “B KafC”, a website that trades games items, etc. on the same day on November 28, 2017, and makes a false statement to the effect that “a victim who reported and contacted the above writing will transfer the said online game D E positions to F by means of G message,” and that the said victim would have the said victim transfer KRW 100,000 to H bank account in the name of H (J) that sells the software on the same day, and the Defendant acquired the same amount of pecuniary benefits by receiving the software program from H.

2. On December 9, 2017, the Defendant: (a) reported on the purport that he would transfer an online game D E position posted on the said bulletin board; and (b) agreed to contact K that he/she would contact the said bulletin with K and receive the said position at KRW 2 million.

On December 10, 2017, the Defendant sent K a G message to K to certify the identity of the party by accessing Internet banking services.

Recognizing to the purport that “If a group beauty program is installed and a remote control application is filed,” K installed the above program on a computer and approved the Defendant’s request for remote control.

Defendant 1, as above, operated a computer through a remote control, intrudes into the K account of the online game D Information and Communications Network by means of a remote control, and held by K

E was arbitrarily transferred to the account used by the defendant.

Accordingly, the Defendant violated the information and communication network without legitimate access authority or beyond the permitted access authority.

3. On January 9, 2018, the Defendant, around January 9, 2018, comments to the effect that “an online game E position is transferred” on the said bulletin board.
