Reasons
Punishment of the crime
1. On June 15, 1984, the Defendant was sentenced to imprisonment with prison labor for eight months in the Gwangju District Court for habitual larceny; on September 6, 1989, ten months in prison and two years in suspended execution; on December 17, 1998, one year in prison and two years in suspended execution of sentence for attempted larceny in the Chungcheong District Court’s support for the Chungcheong District Court; on February 2, 2004, ten months in prison and one year in prison for larceny, etc.; on November 17, 2008, one year and six months in prison for the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny); on June 21, 2013, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (aggravated Punishment, etc.) at the Suwon District Court’s assistance for Scandju.

Between around 02 02:32, after entering the ginseng cultivation area owned by the victim F in Yongju, approximately approximately KRW 3,000 roots ( approximately KRW 400, KRW 1,750g) of the total market price of the five years nearby the five-year period, the ginseng was stolen by the same method as in the attached Table 1 of the Crimes List 1, in the market price, which is the victims’ possession, over 13 times.
Accordingly, the Defendant, who was sentenced to imprisonment not less than three times due to larceny, stolen property owned by another person.
2. On October 9, 2016, the Defendant purchased a stolen ginseng of KRW 22,00-23,00 per one bond (750g) (750g) with knowledge of the fact that the ginseng was stolen, and acquired it on 13 occasions, such as that of the attached Table 2, as shown in the attached Table 1, from the Defendant’s house located in Seoul Special Metropolitan City, G and 102, upon receipt of a request from the Defendant for purchase of some (5-30km) of the ginseng that was stolen as described in the above 1.
