A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

1. Larceny;

A. In March 2014, the Defendant: (a) committed a theft of 100,000 won on the Defendant’s car by carrying a yellow fat, which was the victim’s possession, into the victim’s orchard C, located in Jeju Island; and (b) on the part of the Defendant’s car.

B. On April 12, 2014, around 19:00, the Defendant: (a) committed a theft by carrying 1,000,000 won in the Defendant’s car into the Victim E’s House located in Jeju Island; (b) the victim’s market price, which is linked to the said house, was at least one million won; and (c) the Defendant stolen the Defendant’s car.

C.
