A person shall be punished by imprisonment with prison labor for a term of life or for a term of two years as stated in the judgment of the defendant.

Punishment of the crime

On April 6, 2007, the defendant was sentenced by the Seoul Western District Court to imprisonment with prison labor for the crime of attempted robbery, 1 year of suspended execution, 2 years of indecent act by force, and the judgment on April 14, 2007 became final and conclusive.

1. In order to raise money for robbery, the Defendant, who was robbery, pretended to visit a faculty, who is relatively easy to commit robbery, to commission the child to a child-care center that works as a teacher, led women to threaten the child-care center teacher to take money and valuables by threatening the child-care center teacher in knife. 피고인은 2006. 3. 13. 07:55경 성남시 중원구 E빌딩 2층에 있는 ‘F 어린이집’에 들어가 그곳 놀이방에서 혼자 출근하여 어린이들을 맞을 준비를 하고 있는 피해자 G(여, 25세)에게 “자녀를 둔 학부모인데 어린이집에 자녀를 위탁하기 위하여 상담도 받고 어린이집의 시설을 미리 구경해 보려고 방문하였다”라는 취지로 거짓말하여 그 말을 믿은 피해자의 안내를 받아 위 어린이집을 모두 둘러보고 다른 사람이 없다는 사실을 확인한 후 갑자기 바지 오른쪽 주머니에서 위 과도를 꺼내어 오른손에 쥐고 피해자의 목을 벨 듯이 겨누면서 “돈을 내 놓아라”라고 말하고, 이에 깜짝 놀라 순간 멈칫거리는 피해자의 왼쪽 얼굴 및 턱 아래 부위를 왼손 주먹으로 각 1회 때린 다음 피해자의 등 뒤로 가서 위 과도로 피해자의 등 부위를 수회 쿡쿡 찌르면서 “돈이 어디에 있느냐 그곳으로 가자.”라고 말하며 피해자의 등 뒤에서 왼손으로 피해자의 목 뒷덜미를 움켜쥐고 위 과도로 목을 벨 듯이 겨누면서 피해자를 앞세우고 피해자의 손가방이 있는 사무실로 데려가 겁에 질린 피해자로부터 손가방을 가로채 그 속에 들어 있는 현금 30만 원 및 휴대전화기...
