Reasons
Punishment of the crime
[2014 Highest 59] The Defendant was sentenced to four months of imprisonment on May 20, 2010 for a violation of the Road Traffic Act in the Jeonju District Court’s Seoul District Court’s branch on May 20, 2010, and on February 16, 2012, the Gwangju District Court sentenced eight months of imprisonment for a violation of the Road Traffic Act (driving) at the Gwangju District Court on February 16, 2012, and completed the execution on October 17, 2012.
【Criminal Facts】
1. Larceny;
A. On December 27, 2013, around 21:50 on December 27, 2013, the Defendant: (a) committed a theft by driving a Fpoter vehicle, the market price of which is equivalent to KRW 2,00,000, which is the victim’s market price owned by the victim E, parked in the Mapo-gun located in the said place, using the vehicle heat stringed at that place.
B. On January 3, 2014, at around 17:05, the Defendant: (a) was on the side of the road in front of a H restaurant located in the Gosong-gun G of North Korea; (b) the victim I parked in the victim I, using the vehicle heat stringed at the seat of 4,000,000 won at the victim’s husband’s her seat; and (c) was stolen by driving a kschton vehicle using the vehicle heat stringed at that seat.
2. Around 21:50 on December 27, 2013, the Defendant driven a F Poter truck without obtaining a driver’s license from the front day of the D’s house located in the Gocho-gun C in the front day of the frontwest-gun C of North Korea to the front day of the said armed forces, the Doctrine of which is a about 6km section without obtaining a driver’s license.
3. Around 17:30 on January 3, 2014, the Defendant violated the Road Traffic Act (driving without a license) and the Road Traffic Act (driving without a license) without obtaining a driver’s license in approximately 500 meters section from the front side of a H restaurant located in Goyang-gun G to the front side of the Yyangyang-dong Village G, and while under the influence of alcohol at least 0.340% under the influence of alcohol.
[2014 Highest 118] The Defendant, at around 19:30 on December 27, 2013, by deceiving the victim M as if he did not have the intent or ability to pay the drinking value in the N entertainment tavern operated by the victim M in Young-gun L, Jeonnam-gun around December 27, 2013.
