A defendant shall be punished by imprisonment for two years.
Evidence seized by the defendant shall be confiscated as provided for in subparagraphs 1 through 14.
Reasons
Punishment of the crime
[criminal power] On May 18, 2018, the Defendant was sentenced to two years of imprisonment with prison labor for special larceny in the Goyang Branch of the Jung-gu District Court, and completed the execution of the sentence in the port prison on December 6, 2019.
【Criminal Facts】
1. On April 1, 2020, around 21:01, the Defendant: (a) invadedd the building managed by the victims C, which was located in the Glang-gun B; (b) and (c) intruded the victim’s structure beyond the rear wall of the above building and the victim’s structure; and (d) as shown in attached Table 1, the Defendant invadedd the building managed by the victims five times in total from around that time to around February 28, 2020.
2. From April 3, 2020 to April 4, 2020 to April 4, 2020, the Defendant: (a) during night building intrusion theft: (b) at the “D” factory managed by the victim C in Gyeongbuk-gun; (c) due to the victim’s leaving the factory by taking advantage of the crebs in which the said factory is undeveloped; (d) taken a crebs in the nearby plastic house; (d) opened the rear fence of the said factory; and (e) intrudes the factory inside the factory; (e) took a crebs after the factory; and (e) took an inside the factory; and (e) took a 10,00,000 won in cash, which was kept in custody on the face of the victim’s books; (e) KRW 1,354,539 won in foreign currency; (e) KRW 1,50,000 in cash and KRW 500,000 in one passport; and (e) KRW 1, 2539,5394 months in cash.
Accordingly, the defendant invadedd a structure managed by the victims at night, and stolen the victims' property.
3. On April 17, 2020, from around 01:07 to 02:32, the Defendant: (a) intruded the “D office” managed by the victim C in the Glangdong-gun B by the said method into the said factory; and (b) partially damaged the factory entrance by using the spackner, but (c) returned to the window behind the factory without any door.
