Reasons
Punishment of the crime
[Criminal Power] On April 26, 2018, the Defendant was sentenced to two years of suspension of the execution on August 4, 2018 by the Suwon District Court for the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, and the judgment became final and conclusive on May 4, 2018.
【Criminal Facts】
1. Around October 6, 2013, the Defendant, “2018 Man-Ma6044, the Defendant,” saying, “AB agency run by the victim AW in Suwon-si, Suwon-si, and that, if the Defendant developed and sells the leased land of the Plaintiff, the Defendant would be able to fully repay the money that the Defendant borrowed from the victim before the purchase and sale of the leased land of the Plaintiff, and the Defendant would be able to fully repay the money that the Defendant would have not yet repaid. As such, the Defendant would lend KRW 10 million at the cost necessary for obtaining authorization and permission to develop the said land.
However, when the defendant receives the above money from the victim, he did not have any intention or ability to proceed with the procedure of authorization or permission for the development of the above land only when he thought that he would operate the construction company's operating expenses, the monthly salary of its employees, or the personal use of the defendant.
Nevertheless, the Defendant got a false statement to the victim and received from the victim the transfer of KRW 10 million in the name of land development in the BD bank account (Account Number: BE) in the name of the Defendant’s employee on the 7th day of the same month.
Accordingly, the defendant was given property by deceiving the victim.
2. The Defendant is a representative operating U.S. Co., Ltd., Qast Co., Ltd., Ltd., BF, and BG from around 2009 to a person who actually runs BH, BI, D, BJ, BJ, BK, BL, BM, BN, BP, BP, Q, BR, BS, BT, BU, BU, BU, BU, and BV.
No person who violates the Wastes Control Act shall dispose of wastes in any place other than those prepared for the collection of wastes, such as a Special Self-Governing City Mayor, Special Self-Governing Province Governor, head of a Si/Gun/Gu, park or road.
