1. All of the plaintiffs' claims are dismissed.

(a) The filing date, registration date, and registration number of the Defendant’s registered trademark, service mark (A No. 1 No. 1) 1/registration date: 19/ May 19, 2011; 3) Category 3 of product classification for designated goods and service business: Boscen, bathing cosmetics, cosmetics, cosmeticcencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencencenc, boom and boom, e.

B. On June 30, 2015, the plaintiffs (Evidence 2 No. 1) recognize the defendant as the holder of the right to register the registered trademark/service mark of this case against the Intellectual Property Tribunal on June 30, 2015, "the registered trademark/service mark of this case" as the mark of the cosmetic containing PPED (PPEDE) or the cosmetic-related service using the cosmetic, which is the raw material of the cosmetic, to ordinary consumers or traders. Thus, the mark is likely to mislead the quality of the cosmetic-related service using PPED or the cosmetic-related service using such cosmetic.

Therefore, the instant registered trademark/service mark constitutes Article 7(1)11 of the former Trademark Act (amended by Act No. 14033, Feb. 29, 2016; hereinafter “former Trademark Act”).

2) On January 25, 2016, the Korean Intellectual Property Tribunal filed a petition for registration invalidation trial on the instant registered trademark/service mark with the purport to the effect that the instant registered trademark/service mark was invalidated, and the Korean Intellectual Property Tribunal deliberated on the said petition for adjudication in the case of 2015Da3728, and reported products bearing the instant registered trademark/service mark “” by ordinary consumers and Pepsisisisisid.
