1. The defendant is against the plaintiff and the plaintiff

Reasons

1. Basic facts

A. On February 29, 2008, the Plaintiff leased (hereinafter “instant shopping district lease agreement”) a portion of 23.14 square meters inboard (A) which successively connected each point of 1, 2, 3, 4 and 1, among real estate 1st floor 515.64 square meters listed in the attached Table 1 list, to the Defendant, with a lease deposit of KRW 6,000,000, monthly rent of KRW 550,000, and a period of one year (hereinafter “instant shopping district lease agreement”).

B. According to the commercial building lease contract of this case, a lessor may terminate the contract when the lessee has failed to pay the monthly rent not less than three times (Article 7); the contract is automatically extended under the same condition unless the lessor notifies the lessee of the refusal of renewal or the change of conditions between six months and one month before the expiration of the contract (Article 8); the lessee shall restore the leased real estate at his own expense to its original state and return it to the lessor (Article 9); and the lessee cannot demand the lessor to pay the premium or the premium for facilities.
