A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On October 4, 2016, the Defendant was sentenced to one year of imprisonment for a crime of fraud, etc. in the Gangwon District Court Goyang branch on March 21, 2017, and completed the execution of the sentence in the Young prison on March 21, 2017.

On October 15, 2019 and November 18, 2019, the Defendant called the victim C'D operation in Daegu-gu Dong-gu, Daegu-gu, "D', under the influence of alcohol in a restaurant, was suffering from interference with business by avoiding disturbance. On December 7, 2019, the Defendant demanded the alcohol in the state of alcohol under the influence of alcohol in the above restaurant, and went out of the victim's refusal.

1. On December 7, 2019, at around 16:25, the Defendant ordered the victim’s drinking at the “D” restaurant operated by the Daegu Dong-gu, Daegu-gu, the Defendant: (a) stated that “I cannot drink any alcohol” from the victim; (b) stated that I would like to see the victim’s words “Isker, Isker, Isker, Isker, Isker to do so at all night; and (c) attempted to see the victim and its customers who are in the place of the victim and customers, and see their will.

Accordingly, the defendant interfered with the victim's restaurant operation by force for about one hour.

2. On December 7, 2019, at around 20:25, the Defendant ordered the victim to alcoholic beverage and alcohol, but was refused to provide it from the victim, the Defendant was able to avoid disturbance, such as raising a disturbance, by stating that “I would like to provide food to the victim, I would like to say, “I would like to provide food to the victim, I would like to see that I would like to say, “I would like to provide food to the victim, I would like to go with the food, I would like to see, I would like to say, “I would like to drink, I would like to do so,” even

Accordingly, the defendant interfered with the victim's restaurant operation by force for about five minutes.

3. On December 7, 2019, the Defendant issued an order for food to the said restaurant and the victim, even though the police officer returned to Korea after receiving a report due to the interference with the business as set forth in paragraph (2) of the same Article, and was given the order for food to the said restaurant and the victim, and the Defendant issued an order for food to the said restaurant and received such provision, and food from the victim.
