A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On May 2017, the Defendant: (a) received a proposal from a nameless person who reported and contacted online loan advertisements to create a corporate business operator to improve the sales performance and obtain loans; (b) did not have a plan to conduct business activities according to the actual purpose; (c) did not have an office, and (d) did not establish a corporation with no real entity since it did not have invested capital in the document form; and (d) opened an account in the name of the corporation and delivered it to the nameless person.

On May 2018, the Defendant sent a personal seal impression, resident registration record card, seal, driver's license, etc. in the name of the Defendant necessary for the establishment of a corporation to the deceased on his/her own, in accordance with the foregoing proposal from the deceased on his/her name.

On May 21, 2015, when submitting false documents necessary for the establishment of a corporation, such as office lease agreement, list of shareholders, certificate of payment of stock price, etc. prepared by the defendant from the registry office of the Seoul Central District Court located in Seocho-gu Seoul Central District Court, Seocho-gu, Seoul Central District Court, by using the certificate of personal seal impression issued by the defendant, etc., and applying for registration of incorporation with inside directors, the location of the head office of the company, "Seoul Special Metropolitan City C buildings, D", and the purpose of "computer parts and goods sales business, etc.", and let the public official in charge of trusting such registration input the above registered matters in the commercial registration electronic data processing system. The public official in charge of trust submitted false documents necessary for the establishment of a corporation, such as office lease agreement, register of shareholders, certificate of payment of stock price, etc., and submitted false documents, which are sent by the defendant from the registry office of the Seoul Central District Court located in Seocho-gu Seoul Central District Court.
