Reasons
Punishment of the crime
【The Defendant was sentenced to one year of imprisonment for fraud at the Seoul Western District Court on October 15, 2013, and completed the execution of the sentence in the case of three North Korean Dos on June 3, 2014.
【Criminal facts】 On December 15, 2016, the Defendant posted a statement on the Defendant’s house of 1214 Dong-dong, Incheon, Nam-gu, Incheon, 1004, having access to the Defendant’s house of 1214 Dong-gu, 1004 G apartment, and having access to the Defendant’s home page via Handphones, selling Aphone equipment. The Defendant was remitted KRW 300,000 as sales price from the victim C who believed the above notice to be true.
However, the defendant did not have the intent or ability to sell the promised electronic equipment.
In addition, from around that time to December 18, 2016, the Defendant received a total of KRW 1,160,000 from the victims four times in total, such as the statement in the list of crimes in the attached Table, from around that time to around that time.
Accordingly, the defendant deceivings the victims and received property from the victims.
On December 20, 2016, the Defendant posted a letter stating that he/she sold S29.7LTE at a galloning gallon, after accessing the Defendant’s house No. 1214, 1004, Nam-gu, Incheon Metropolitan City apartment house No. 1214, 1004, via a Handphone, and then, he/she was transferred KRW 365,00 as the price for goods from the victim F who believed that the notice was true to be a single bank account in the name of the Defendant.
However, the defendant did not have the intent or ability to sell the promised electronic equipment.
In addition, from around that time to January 23, 2017, the Defendant received a total of KRW 2,455,000 from the victims eight times in total, including the statement in the list of crimes attached to the Defendant’s house (if the “F” No. 5 victim is deemed to be a clerical error in the J”) from the Defendant’s house.
Accordingly, the defendant deceivings the victims and received property from the victims.
The defendant of "2017 Highest 1936" shall be around December 13, 2016.
