가. 물품판매대금 사기의 점 피고인은 2013. 11. 12경 청주시 상당구 G 206호에 있는 피고인의 집에서, 피고인의 휴대전화를 이용하여 인터넷 네이버 중고나라 카페에 "롤챔스 15일 R석 3연석 판매 합니다"라는 글을 게시한 후 2013. 11. 13.경 위 글을 보고 연락한 피해자 H에게 “65,000원을 입금하면 티켓을 보내주겠다”라는 취지로 말하였다.

그러나 사실은 피고인은 롤챔스 티켓을 가지고 있지 않았고 별다른 직업이나 재산이 없었기 때문에 피해자로부터 금원을 송금받더라도 피해자에게 롤챔스 티켓을 보내줄 의사나 능력이 없었다.
