피고인은 2013. 3. 22. 15:35경 전주시 완산구 평화동 1가에 있는 농협 장승백이 지점에서 택시 거스름돈이 잘못 계산되었다고 위 농협지점장 및 청원경찰에게 욕설하고, 시비를 걸며 행패를 부리다가 신고를 받고 출동한 경찰공무원인 피해자 B이 거스름돈은 이상이 없으니 농협에서 나가달라고 요구하자 농협 직원 3명과 고객 약 20여 명 있는 자리에서 피해자에게 ‘시벌 놈들아, 니들이 뭔데, 죽여 버린다, 이 좆밥 같은 새끼들아’라고 큰소리로 말함으로써 공연히 피해자를 모욕하였다.
