1. The defendant shall pay 80,000,000 won to the plaintiff and 15% per annum from January 9, 2016 to the day of complete payment.

The Defendant borrowed KRW 60,00,000 on May 31, 2007 to the Plaintiff, respectively, and KRW 30,000,000 on November 20, 2014; the Defendant, while leasing a building owned by the Defendant to the Plaintiff, provided that the Plaintiff would substitute the above loan amount of KRW 90,00,000 as a security deposit; however, the said lease became invalidated; accordingly, the Defendant repaid the Plaintiff KRW 10,00,00 to the Plaintiff on June 19, 2015, but the remainder of KRW 80,00,000 has not been repaid to the present time is recognized by adding the overall purport of pleadings to the evidence Nos. 1 through 3.

Therefore, the defendant is obligated to pay to the plaintiff the amount of KRW 80,000,000 and damages for delay calculated at the rate of 15% per annum from January 9, 2016 to the day of full payment as requested by the plaintiff, which is the day following the delivery of a copy of the complaint of this case. Thus, the plaintiff's claim of this case seeking this payment is justified and it is so decided as per Disposition.
