Defendants are not guilty.

1. Defendant A is the chairman of the “E elementary school mother association” in Ansan-si D, and Defendant B is the chief director of the said elementary school mother association.

On December 3, 2011, at a “G” restaurant located in Ansan-si, F, the Defendants: (a) Defendant B divorcedd from the principal of the above elementary school; (b) although there was no fact that the principal of the above elementary school was embezzled, Defendant B, despite of the fact that the principal of the above elementary school was embezzled, embezzled the public funds to the victims; and (c) Defendant A had embezzled the public funds to the extent that the portion of divorce was made at another elementary school; and (d) Defendant B has damaged the honor of the victims by openly pointing out the fact and false facts with the purport that Defendant B’s speech is consistent.

2. The Defendants consistently asserted that: (a) in a restaurant “G” is accompanied by the E elementary school; (b) the principal’s inappropriate act was divided into paper and explained by the Board of Audit and Inspection as to the contents of the civil petition submitted to the Board of Audit and Inspection; and (c) there was no doubt that H made a speech about the privacy of H or embezzled public funds in another school; and (d) there was a statement by H, I, and J as evidence consistent with the facts charged.

However, considering the following circumstances, it is difficult to recognize that the Defendants, based on the above statements, damaged the H’s reputation as stated in the facts charged, and there is no other evidence to prove otherwise.

① The content of H’s statement is not that the Defendants did not directly state the same words as the facts charged, but that the Defendants were able to say that the Defendants divorced from I or K and that he embezzled public funds.

② However, in this Court, I did not listen to Defendant B’s Embezzlement’s embezzlement of public funds at a “G” restaurant, and only did it relate to divorce.
