1. The Defendants shall jointly and severally pay to the Plaintiff KRW 70,000,000 and the interest rate thereon from September 24, 2019 to the date of full payment.

On June 8, 2017, the Plaintiff leased Gangnam-si D and E (hereinafter “instant real estate”) from the Defendants from June 30, 2017 to June 29, 2019, and paid deposit of KRW 70 million to the Defendants. Since the Plaintiff delivered the instant real estate to the Defendants, there is no dispute between the parties, the Defendants are jointly and severally liable to pay to the Plaintiff damages for delay calculated at the rate of 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, etc. from September 24, 2019 to the date of full payment, after the original copy of the instant complaint was served to the Defendants.

Therefore, the plaintiff's claim is justified, and it is so decided as per Disposition by applying Articles 98 and 213 of the Civil Procedure Act to the burden of litigation costs and the declaration of provisional execution.
