A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury) and the Road Traffic Act (Non-accident after Accidents) are those engaged in driving motor vehicles BK7.

On June 19, 2018, the Defendant driven the above vehicle while under the influence of alcohol of 0.20% of the blood alcohol concentration of 0.20% on the 21:40% on June 19, 2018, while driving the vehicle, the Defendant driven the two-lanes of the two-lanes in front of the northwest of the 363 North Korean Peninsula from C to Dongcheon-dong, along the two-lanes on the 3-lane.

At night and on the lane where the defendant intends to enter, there are already different automobiles, so there was a duty of care to prevent accidents by reducing speed and entering the lane well by checking the front and rear left.

Nevertheless, the Defendant, while under the influence of alcohol, neglected to enter the lane as it was and by the negligence of entering the lane, got the front side of the victim D(21 years old) who was driving from the same lane to the racing station on the same lane, and received the front side of the car from the Defendant.

Ultimately, due to the above occupational negligence of the defendant, the defendant suffered injury to the victim, such as brain, without an open head in need of treatment for about three weeks, and at the same time, the above bicycle was damaged to fall within the amount of 45,000 won for repairing expenses and escaped without taking necessary measures, such as aiding the victim.

2. On June 19, 2018, the Defendant: (a) was under the influence of alcohol with a blood alcohol content of about 0.20% from around 1.5km to around 1.5km in the front of the “F” road in the Si-si on the 19th of June 19, 2018; and (b) was driving BK7 without obtaining a driver’s license.
