피고인과 C, D, E, F, G는 2012. 4. 28. 15:00경 인천 서구 H 비동 302호(I주택)에 있는 E의 집에서, D, E가 아르바이트 일을 해서 모아 둔 현금 170만 원을 피해자 J(19세)이 몰래 가지고 가서 피해자 K(18세, 여), 피해자 L(15세)와 사용하였다는 이유로 화가 나, 피해자들을 무릎 꿇게 한 후, E는 행거로 피해자 K와 피해자 J의 얼굴 등을 때리고 주먹으로 피해자 K와 피해자 J의 얼굴과 배 부위를 수회 때린 다음, 프라이팬으로 피해자 K와 피해자 J의 머리를 때리고, 피고인들은 주먹과 손바닥으로 피해자 K의 머리와 배를 수회 때리고, F은 손바닥과 무릎으로 피해자 J의 얼굴을 수회 때리고, D, E는 손바닥으로 피해자 L의 얼굴을 수회 때리고, 계속하여 피고인과 C, D, E, F, G는 같은 날 17:00경 인천 부평구 청천동 나비공원으로 피해자들을 끌고 가 D, F, G는 주먹과 발로 피해자 J의 얼굴을 수회 때리고, F은 라이터를 켜 뜨겁게 한 후 피해자 J의 등에 갖다 대고, 피고인들과 D, E, G는 피해자 K를 발과 손으로 수회 때리고 머리채를 잡아당기고, G는 발로 피해자 L의 낭심 부분을 차고, E는 피해자 L의 머리채를 잡고 발로 얼굴을 찼다.
