1. Around June 14, 2012, at a place where it is impossible to identify the place below the original city, the Defendant told C to send the victim the amount of KRW 6 million in the contract amount to the victim by June 19, 2012.

However, even if the defendant receives down payment from the victim, he did not have the intention or ability to send scarb trees to the victim.

As above, the Defendant made a false statement to the victim, i.e., KRW 2.5 million from the victim, i.e., KRW 3.5 million from the victim, and 3.5 million from the same month, was remitted to each account under the name of the Defendant as the down payment.

2. On May 9, 2012, the Defendant called “around May 9, 2012, the victim D by telephone at a place where the location is unknown,” and “around one week, the Defendant would make an investment of KRW 2 million with a view to creating KRW 3 million remaining after leaving the benefit of KRW 5 million.”

However, even if the defendant received investment money from the victim, he did not intend to use it for purchasing landscaping trees. At the time, the defendant did not have any intention or ability to return the investment money because he was in excess of his obligation.

As above, the Defendant made a false statement to the victim, and acquired 2 million won from the victim as the investment money on May 10, 2012, by transfer from the victim to the account under the name of the Defendant.

3. On May 23, 2012, at a permanent post office located in permanent residence, the Defendant called “If you send KRW 10 million with contract deposit, you will send KRW 80,000 to 80,000,000.”

However, even if the defendant receives down payment from the victim, he did not have the intention or ability to send the above trees to the victim.

As above, the Defendant makes a false statement to the victim, i.e., KRW 5 million from the victim’s seat, and KRW 5 million on the 25th of the same month, respectively, under the name of the Defendant, under the name of the Defendant, as the down payment for the king Pluk Dok k
