Defendant

A is the head of the Dongdaemun-gu Seoul Association, who is subject to the suspension of duties by the president of the Association, and the defendant B, the defendant C, the defendant D, the defendant E, and the defendant F are disabled persons with a pro-friendly relationship.

1. Defendant A tried to interfere with holding an extraordinary meeting to dismiss all the executives of the association including the Defendant by organizing a so-called emergency response committee by the victim K, who is a member of the above JJ association.

피고인은 2013. 11. 14.경 서울 동대문구 L 신한은행 건물 2층에 있는 위 조합사무실에서 C에게 “내일 모레 동대문구 M에서 조합장 해임 총회가 열리는데 머리가 아프다”라고 말하고, 이에 C는 2013. 11. 15. 12:00경 D을 만나 위 임시총회 개최를 방해하기 위해 장애인들을 동원해 달라는 취지로 요구하고, D은 2013. 11. 15. 15:00경 B에게 전화를 걸어 위 임시총회 개최를 방해하기 위해 장애인들을 동원해 달라는 취지로 요구하고, 이에 B는 즉시 피고인에게 전화를 걸어 장애인들을 동원하여 임시총회 개최를 방해해 달라는 요구를 한 것이 맞는지 확인하여, 이에 피고인은 맞다는 취지로 답변하여, 이에 따라 B는 장애인들을 동원하기 위해 E에게 연락하고, E은 다시 F에게 연락하여, F은 노원역 인근 삿갓공원에서 평소 모여 놀고 있는 장애인들에게 일당 5만 원을 주겠다고 제안하여 성명불상의 장애인 5명 상당을 모집하였다.
