A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
On August 22, 2017, the Defendant was sentenced to imprisonment of one year and two months with prison labor at the District Court for fraud, and on March 20, 2018, the execution of the sentence was terminated in the Ansan Prison on March 20, 2018, and on March 22, 2019, the Seoul Central District Court sentenced one year and six months of imprisonment with prison labor at the Seoul Central District Court for fraud, and completed the execution of the sentence in the Ansan Prison on December 1, 2019.
At around 22:30 on March 12, 2020, the Defendant received food and alcoholic beverages equivalent to KRW 30,400,00 in total from the victim, including skins and spaws, as if he did not have the intention or ability to pay the price, and acquired it by deception, by taking the fact into account that he did not have the intention or ability to pay the price.
Around 20:00 on January 28, 2020, the Defendant received food and alcohol equivalent to KRW 43,500,00 in total from the victim, such as skin and so on, as if he did not have any intent or ability to pay the price, and acquired the food and alcohol from the victim, even though he did not have any intention or ability to pay the price.
around 19:04 on April 17, 2020, the Defendant obtained food and alcohol equivalent to KRW 31,000,000, in total, as food and drink from the victim, 31,000, by committing a criminal act as if he/she did not have any intent or ability to pay the price, and as if he/she did so, he/she did so.
Around 22:30 on August 29, 2020, the Defendant received food and alcohol equivalent to KRW 38,900 in total from the victim, such as skin and so on, as if he did not have the intention or ability to pay the price, and acquired the food and alcohol from the victim, even though he did not have the intention or ability to pay the price.
